As an employer, it is imperative that you, first of all, create a disciplinary procedure and secondly make it accessible to all staff. This would include what type of performance and behaviour could lead to the dreaded disciplinary action. The procedure should also follow a structure for a fair and legal investigation.
Why Is a Disciplinary Policy / Procedure Necessary?
Having a disciplinary procedure in place helps to manage employees and ascertain any misconduct within the business. This is generally outlined in a staff handbook when they arrive at the business. Having a disciplinary procedure that follows the Acas code of practice will also put you in good stead should an investigation lead to a tribuneral.
