Tamworth Theme Park Sentenced
A Tamworth theme park has been sentenced and fined £1 million following a tragic fatality at their park back in 2017.
The theme park owners at the time, pleaded guilty to breaching Section 3(1) of the Health and Safety at Work etc. Act 1974.
The young girl, who tragically lost her life at the theme park, was on a school trip at the time of the incident. The HSE heard how she fell out of a raft on a water ride into the ride’s water trough. She was able to wade to the conveyer belt at the end of the ride and climb onto it, but then fell into a section of deeper water and drowned.
Following a thorough investigation at the theme park, the findings indicated that the risk assessment which was in place was not suitable or sufficient. Not only that, it did not properly assess or address the risk of passengers being ejected from the raft. This was even despite previous similar incidents.
In addition to this, the HSE also found that there was a lack of visibility around the theme park to identify or detect a person in the water as the CCTV only covered half of the ride. There were also no measures or systems in place to rescue anyone who who had fallen into the water.
HSE spokesman said: “As a result of their failings 11-year-old Evha Jannath, died at the end of what should have been a fun day out.”
